Eddie Garcia notifies city of impending action
A local radio show host notified the City of La Grande Monday afternoon that he intends to file a legal action against the municipality.
Edward “Eddie” Garcia, in an email to City Manager Robert Strope, notified the city and its legal counsel that he intends to file a legal action for damages and relief against the City of La Grande.
In the letter, Garcia alleges the city has violated his civil rights and rights to due process.
The pending legal action stems in part from a Sept. 5, 2013, incident during which Garcia alleges that La Grande Police Department Sgt. John Shaul omitted information in a report. Garcia was charged at the time with criminal trespass for allegedly entering the home where his ex-girlfriend was living.
Garcia’s letter also states that in August 2013 officer David Sams made a comment to Garcia that was taken as racially motivated, and that Police Chief Brian Harvey later in August asked Garcia to withdraw a complaint made on several LGPD officers. The complaint was reinstated in November.
Garcia did not respond to multiple requests seeking comment.
Strope declined to comment on the pending litigation, but did say that filing of a tort claim, as a precursor to a lawsuit, is a fairly normal thing.
“It’s not an uncommon occurrence,” Strope said.
Over the past several months Garcia, host of the “Speak Your Mind” radio talk show, has lodged a number of formal complaints against LGPD officers, a Union County deputy district attorney and others.
Last week, Garcia’s attorney in his trespassing case, Steve Joseph, resigned, citing a conflict of interest, according to court documents. Joseph’s firm, Joseph & Ricker, LLC., represents the City of La Grande.
Garcia, whose show has relaunched following a brief hiatus, pled not guilty to the trespass charge in court last month. It is unclear whether Garcia will represent himself in future court matters or whether he will retain other legal counsel.
