AMENDED TRUSTEE'S NOTICE OF SALE

Reference is made to that certain trust deed made by Jane F. Kusaka, as grantor, to Abstract & Title Company, as trustee, in favor of Idaho Mutual Trust, LLC, an Idaho limited liability company, as beneficiary, dated October 28, 2005, recorded November 2, 2005, in the land records of Union County, Oregon, as Document Nos. 20055931, 20055932, 20055933, and 20055934, covering the following described real property situated in the above-mentioned county and state, to-wit: Lot 2 of PONDOSA ACRES SUBDIVISION, according to the recorded plat, as filed in Plat Cabinet "C", pages 708 and 709, records of Union County, Oregon. SITUATE IN the County of Union, State of Oregon. The beneficiary and trustee have elected to sell the said real property to satisfy the obligations secured by said trustee and the notice of default was recorded pursuant to ORS 86.735(3). The default for which foreclosure is made is grantor's failure to pay when due the following sums: Monthly payment of $1,275 due 10/5/07; plus late charges of $63.75; principal payment of $120,000, due 11/1/07; accrued default interest of $3,372.86 due 11/1/07; and accrued default interest of $56.55 per day beginning 11/1/07. By reason of the default, the beneficiary has declared all sums owing on the obligation secured by the trust deed immediately due and payable, those sums being the following, to-wit: October 2007 monthly payment of $1,275; plus late charges of $63.75; principal payment of $120,000, accrued default interest of $3,372.86 calculated through 10/31/07, and accrued default interest of $56.55 per day beginning 11/1/07, attorney fees of $1,000 (per ORS 86.753(1)(a), default fee of $6,071.25, and all costs and expenses actually incurred in enforcing the obligation and trust deed. The amount required to discharge this lien in its entirety to date is $133,057.86 plus default interest in the amount of $56.55 per day from 11/1/07. WHEREFORE, notice hereby is given that Idaho Mutual Trust, LLC, the undersigned trustee by reason of said default will on May 7, 2008, at 2:00 pm, pursuant to ORS 86.705 et seq, at the Main Entrance of the Union County Courthouse, 1007 4th St, City of La Grande, County of Union, State of Oregon, sell at public auction to the highest bidder for cash the interest in the described property which the grantor had, or had the power to convey, at the time of the execution by grantor of the trust deed, together with any interest the grantor or grantor's successor in interest acquired after the execution of the trust deed, to satisfy the obligation secured by the trust deed and the expenses of the sale, including the compensations of the trustee as provided by law, and the reasonable fees of trustee's attorneys. Notice is further given that any person named in ORS 86.753 has the right, at any time prior to five days before the date last set for the sale, to have this foreclosure proceeding dismissed and the trust deed reinstated by payment to the beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or trust deed, and in addition to paying the sums or tendering the performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and trust deed, together with the trustee's and attorney's fees not exceeding the amounts provided by ORS 86.753. In construing this notice, the singular includes the plural, the word "grantor' includes any successor in interest to the grantor as well as any other person owing an obligation, the performance of which is secured by the trust deed, and the words "trustee" and "beneficiary" include their respective successors in interest, if any. INVITATION TO BID

Sealed bids will be received at the Community Connection of Northeast Oregon, Inc. Office by Frank Thomas, at 1504 Albany Street, La Grande, Oregon until 9:00 A.M. Tuesday February 5, 2008, for the Northeast Oregon Public Transit Building, and then they will be opened publicly and read aloud at 9:05 A.M. at the Senior Center Conference Room. Any questions or comments may be addressed by contacting Frank Thomas at (541) 963-7532.

Bids received after the date and time above will not be considered.

In general, the work consists of approximately 5,000 square feet of a wood framed building with wood wall and roof system, and composition shingle roofing. The project includes site development including site utilities, landscaping, paving, signage and concrete walks. Work under this contract will be funded by Connect Oregon Funding and will be subject to ORS 279C.800 et seq (Prevailing Wage Rates).

Contract Documents may be examined at the Community Connection Office at 1504 Albany Street, La Grande, Oregon.

Bidders may obtain one (1) sets of Documents at the Community Connection Office at 1504 Albany Street, La Grande, Oregon 97850, phone (541) 963-7532 for a $50 non-refundable fee.

Bids will be considered only if accompanied by a cashiers check or certified check or bid bond (with bona fide surety company such as Surety) made payable to Community Connection in the amount of 10% of the bid amount. No interest will be paid on bid security.

No offer will be received or considered by the contracting agency unless the offer contains a statement by the offerer as a part of his offer that the contractor agrees to be bound by and will comply with the provision of ORS 279C.840 or 40 USC276A.

The contracting agency will not receive or consider an offer for a public improvement contract unless the offerer is registered with the Construction Contractors Board or is licensed by the State Landscape Contractors Board as specified in OAR 137-049-0230.

Community Connection reserves the right to reject any and all bids not in compliance with the prescribed public bidding procedures and Invitation to Bid requirements and may reject for good cause any and all bids upon finding that it is in the best public interest to do so.

Bidders may not withdraw or modify their bid after the time established for the bid to be due.

In accordance with ORS 279A, preference to Oregon residents will be given when awarding the Contract by adding a non-resident's bid the same percentage, if any, given to the bidder by the bidder's home state. Accordingly, bidders will be required to indicate on the Bid Form whether the bidder is an Oregon Resident.
