TRUSTEE'S NOTICE OF SALE

Reference is made to that certain trust deed made by Neal W. Price, as grantor, to Eastern Oregon Title, as trustee, in favor of First Union Mortgage Corporation, as beneficiary, dated 08/04/98, recorded 08/10/98, in the mortgage records of Union County, Oregon, as 984139 and subsequently assigned to Mellon Mortgage Company by Assignment recorded as 20015322, covering the following described real property situated in said county and state, to wit: Lot"A" of Botz Subdivision, situate in the Northwest quarter of the Northeast quarter of Section 16, in Township 1 North, Range 39 East of the Willamette Meridian, in Union County, Oregon, according to the Plat of said Subdivision filed August 15, 1980, in Cabinet "A" Slide 255, records of Union County, Oregon. Together with an easement and covenant, as granted by Declaration executed by Edward A. Botz and LaVeta D. Botz, husband and wife, dated September 10, 1980, recorded September 11, 1980, as Microfilm Document No. 95714, records of Union County, Oregon. PROPERTY ADDRESS: 65617 RIDGEWAY LANE, ELGIN, OR 97827. Both the beneficiary and the trustee have elected to sell the real property to satisfy the obligations secured by the trust deed and a notice of default has been recorded pursuant to Oregon Revised Statutes 86.735(3); the default for which the foreclosure is made is grantor's failure to pay when due the following sums: monthly payments of $928.38 beginning 11/01/06; plus late charges of $36.23 each month beginning 11/16/06; plus prior accrued late charges of $40.60; plus advances of $15.00; together with title expense, costs, trustee's fees and attorney's fees incurred herein by reason of said default; any further sums advanced by the beneficiary for the protection of the above described real property and its interest therein; and prepayment penalties/premiums, if applicable. By reason of said default the beneficiary has declared all sums owing on the obligation secured by the trust deed immediately due and payable, said sums being the following, to wit: $47,096.34 with interest thereon at the rate of 7.125 percent per annum beginning 10/01/06; plus late charges of $36.23 each month beginning 11/16/06 until paid; plus prior accrued late charges of $40.60; plus advances of $15.00; together with title expense, costs, trustee's fees and attorneys fees incurred herein by reason of said default; any further sums advanced by the beneficiary for the protection of the above described real property and its interest therein; and prepayment penalties/premiums, if applicable. WHEREFORE, notice is given that the undersigned trustee will on July 2, 2007 at the hour of 10:00 o'clock, A.M. in accord with the standard of time established by ORS 187.110, at the following place: outside the main entrance of the Daniel Chaplin Building, 1001 4th Avenue Street, in the City of La Grande, County of Union, State of Oregon, sell at public auction to the highest bidder for cash the interest in the described real property which the grantor had or had power to convey at the time of the execution by grantor of the trust deed, together with any interest which the grantor or grantor's successor in interest acquired after the execution of the trust deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable charge by the trustee. Notice is further given that for reinstatement or payoff quotes requested pursuant to ORS 86.757 and 86.759 must be timely communicated in a written request that complies with that statute addressed to the trustee's "Urgent Request Desk" either by personal delivery to the trustee's physical offices (call for address) or by first class, certified mail, return receipt requested, addressed to the trustee's post office box address set forth in this notice. Due to potential conflicts with federal law, persons having no record legal or equitable interest in the subject property will only receive information concerning the lender's estimated or actual bid. Notice is hereby given of a public hearing to be held by the Wallowa County Planning commission on tuesday, April 24th at 7:00 p.m. in the Courtroom of the Wallowa county Courthouse. The agenda for this meeting will include, but is not limited to, the following items:

Daggett ZC#07-03 - Proposal to amend the Wallowa county Comprehensive Land Use Plan text to include a Goal 3 exception to change the zoning classification of 10 acres of real property from Exclusive Farm Use (EFU) to Rural Commercial (R-C) and for a corresponding zoning map amendment. The property in question is described as Township 2 South, Range 45, Section 20, Tax Lot 100.

S&V Properties ZC#07-02 - Proposal to Change the zoning on Tax lots 1000, 1400, 1402, and 1403 in Township 2 South, Range 45, Section 30, Tax lots 1000 and 1001 in Township 2 South, Range 44, Section 25, and Tax lot 1700 in Township 2 South, Range 45, Section 31 from Industrial (M-1) to Recreational Residential (R-2), and to amend the Wallowa County Comprehensive Land Use Plan maps to change the zoning classification from M-1 to R-2.

Written comments must be received by the Wallowa County Planning Department 101 S, River St. Room B-1, enterprise, OR 97828 - by 5 p.m. on Monday, April 23, 2007. Oral comments may be given at the time of the hearing which is open to the public. Those interested in attending are encouraged to do so.
