UNION COUNTY BOARD OF COMMISSIONERS
VESTING DETERMINATION
NOTICE IS HEREBY GIVEN, the Union County Board of Commissioners, meeting in regular session, Wednesday, May 7, 2008, 10:30 a.m., Joseph Building Annex Conference Room, 1106 K Ave.,
La Grande, will make a determination as to whether the approved Measure 37 claims submitted by Lauren & Anita Swartz to create a total of eight buildable parcels from 81 acres to 101 acres in size meet the Oregon court's interpretation of common law vesting.  The subject properties are located about 16 miles southeast of Union near Medical Springs, on both sides of Oregon Hwy. 203 and are described as Twp. 6S, Range 41 EWM, Tax Lots 1800, 1805, 1806 & 1807, about 672 total acres.

APPEAL
NOTICE IS HEREBY GIVEN, the Union County Board of Commissioners, meeting in regular session, May 7, 2008, 1:30 p.m., Joseph Building Annex Conference Room, 1106 “K” Ave., La Grande, Oregon, will consider an appeal submitted by Daniel Heath, managing member of Bear Creek Ranch Quarter Horses LLC, of the Planning Commission's March 24, 2008 decision to approve a forest related dwelling on property owned by Carl W. Hopp Jr.  The property is located about 1.5 miles south of Ore. Hwy 244 and about 4 miles southwest of the Hilgard area and described as Twp. 3S, Range 36 EWM, Tax Lot 1900, about 1350 acres, in an A-4 Timber Grazing Zone and in Big Game Critical Wildlife Habitat.     
The applicable Land Use Regulations are found in Sections 5.03, 20.09 & 34.01 of the Union County Zoning, Partition and Subdivision Ordinance. Notice of Permit
Amendment R-10052
T-10552 filed by Dee Wayne Johnson (Conley Farms), 61050 Conley Road, Cove, Oregon 97824, proposes a change in point of appropriation and a portion of the place of use under Permit G-12578. The permit allows the use of 4.6 cfs (priority dates May 2 1994 for 2.23 cubic feet per second (cfs) and August 17, 1995 for 2.37 cfs) from a well in Sec. 7, T 3 S, R 40 E, W.M. (Catherine Creek Basin) for irrigation in Sects. 6, 7, and 18. The applicant proposes to change the point of appropriation to a well approximately 6800 feet northwest (Sec. 1, T 3 S, R 39 E, W.M.); and to change the place of use to Sects. 1 and 12, T 3 S, R 39 E, W.M. and within Sects. 6 and 7, T 3 S, R 40 E, W.M. The Water Resources Department has concluded that the proposed permit amendment appears to be consistent with the requirements of ORS 537.211. The last date of newspaper publication is May 10, 2008.
