PROPERTY ADDRESS: 760 W BRYAN AVENUE UNION, OR 97883 Both the Beneficiary and the Trustee have elected to sell the real property to satisfy the obligations that the Trust Deed secures and a notice of default has been recorded pursuant to Oregon Revised Statutes 86.735(3); the default for which the foreclosure is made is grantor's failure to pay when due the following sums: monthly payments of $1,118.24 beginning 03/01/2010; plus late charges of $48.28 each month beginning with the 03/01/2010 payment plus prior accrued late charges of $-96.56; plus advances of $ 0.00; together with title expense, costs, trustee's fees and attorney fees incurred herein by reason of said default; and any further sums advanced by the Beneficiary for the protection of the above described real property and its interest therein. Notice is further given that any person named in ORS 86.753 has the right, at any time that is not later than five days before the date last set for the sale, to have this foreclosure proceeding dismissed and the Trust Deed reinstated by paying to the Beneficiary the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by curing any other default complained of notice of default that is capable of being cured by tendering the performance required under the obligation that the Trust Deed secures, and in addition to paying said sums or tendering the performance necessary to cure the default by paying all costs and expenses actually incurred in enforcing the obligation that the Trust Deed secures, together with the Trustee's and attorney fees not exceeding the amounts provided by ORS 86.753. In construing this notice, the singular includes the plural, the word "grantor" includes any successor in interest to the grantor as well as any other person owing an obligation, that the Trust Deed secures, and the words "Trustee" and "Beneficiary" include their respective successors in interest, if any. STANDARD PUBLIC IMPROVEMENT CONTRACT
ADVERTISEMENT FOR BIDS
Sealed bids will be received by the Union Soil and Water Conservation District at 10507 N. McAlister Road, La Grande, Oregon, 97850 until 4:00 p.m. local time Monday, August 15, 2011 for the Little Creek Diversion Dam #1 Replacement project located near the corner next to 66919 Miller Lane, SE Qtr of SW Qtr of Section 11, Township 4 South, Range 39 East, in Union County, Oregon. The project includes [OR is generally described as] demolition and removal of existing concrete diversion structure, installation of a new concrete structure including fish ladder, diversion head gates, appurtenances, and in stream water gap modification.
A mandatory pre-bid conference and examination of the site and conditions will be conducted at l0:00 a.m., Tuesday, August 9, 2011. Bidders shall meet with the Owner's Representative at the diversion project site located at the corner next to 66919 Miller Lane, La Grande, OR 97850, for that purpose.
Bids will be opened and publicly read aloud on Tuesday, August 16, 2011 at 11:00 a.m. local time, at the office of the Union Soil and Water Conservation District by the undersigned or a designated representative.
Bids will be received on an itemized lump-sum basis for all listed work. Contract documents may be obtained [at no charge OR for the cost of reproduction], by request at the Union Soil and Water Conservation District offices at 10507 N. McAlister Road, La Grande, OR 97850, or can be delivered by mail upon written request.
All bidders must comply with requirements of the prevailing wage law in ORS 279C.800, through ORS 279C.870. All bidders must be registered with the Construction Contractor's Board at the time of bid submission. Bidders shall submit evidence of "Affirmative Action Compliance" as required by any Affirmative Action Requirements issued with this procurement. No bid will be considered unless fully completed in the manner provided in the "Instructions to Bidders" upon the Bid Form provided and accompanied by Bid Security.
