On April 22, 2010, the Parties executed a Modification of Promissory Note and Trust Deed, extending the maturity date of the Note for one (1) year, from January 27, 2010 to January 27, 2011 (the “Modification”). As part of the Modification, grantor agreed to pay the beneficiaries the sum of $402.00, such sum representing the cost to prepare a Judicial Foreclosure Guarantee.
The beneficiary and the trustee have elected to sell the real property to satisfy the obligations secured by the trust deed nd a notice of default has been recorded pursuant to ORS 86.735(3); The default for which foreclosure is made is the following:
    (A)    Failure to monthly interest payments of $607.50 beginning November 2010.
    (B)    Failure to pay the entire principal and interest due under the note on or before
        January 27, 2011
By reason of the default, the beneficiary has declared all sums owing on all obligations secured by the trust deed immediately due and payable. The sums owing on all obligations secured by the trust deed are:
    Principal balance, interest, and cost (foreclosure guarantee) through February 17, 2011, in the
    amount of $83,493.99, with interest accruing at a rate of $19.13 per diem.
The undersigned trustee will on Friday, July 15, 2011, at 10:00 a.m., in accord with the standard time established by ORS 187.110, on the front steps of the courthouse, located at 1008 K Avenue, La Grande, County of Union, State of Oregon, which is the hour, date and place last set for the sale, sell at public auction to the highest bidder for cash the interest in the described real property which the grantor had or had power to convey at the time of the execution by grantor of the trust deed, together with any interest which the grantor or grantor’s successors in interest acquired after the execution of the trust deed, to satisfy the foregoing obligations thereby secured and the costs and expenses of sale, including a reasonable change by the trustee.
Any person named in ORS 86.753 has the right, at any time prior to five days before the date last set for the sale, to have this foreclosure proceeding dismissed and the trust deed reinstated by payment to the beneficiary of the entire amount then due (other than such portion of the principal as would not then be due had no default occurred) and by cuing any other default complained of herein that is capable of being cured by tendering the performance required under the obligation or trust deed, and in addition to paying said sums or tendering performance necessary to cure the default, by paying all costs and expenses actually incurred in enforcing the obligation and trust deed, together with trustee’s and attorney’s fees not exceeding the amounts provided by said ORS 86.753.
In construing this notice, the singular includes the plural, the work “grantor” includes any successor in interest to the grantor as well as any other person owing an obligation, the performance of which is secured by the trust deed, and the words “trustee” and “beneficiary” include their respective successors in interest, if any.

THE CITY OF UNION
PLANNING COMMISSION

The Union City Planning Commission will hold a public hearing Wednesday, June 15, 2011, at 7 PM, in the Leonard Almquist Council Chambers, Union City Hall, 342 S. Main Street, on the application by Jay and Julie Peterson for a variance approval. The legal description is (04s40e19bd, tax lot 106) also known as 610 E. Fulton, Union, Oregon. The applicable criteria are found in the Union City Zoning Ordinance 337, Sections 4. Exceptions and Variances, and Section 5. Conditional Use. A copy of the application and all documents and evidence submitted to the City are available for inspection at no cost at the Union City Hall during normal business hours (10 AM – 5:30 PM, Monday thru Thursday.). Copies will be provided upon request, at reasonable cost, and mailed if requested. A copy of the staff report on this application will be available for inspection at no cost no less than seven (7) days prior to the public hearing during regular business hours or copies will be provided upon request at reasonable cost.
Testimony may be presented orally at the hearing or by written statement presented at or before the hearing. Testimony and evidence must be directed toward the applicable criteria or to other criteria in the Zoning Ordinance or Land Use Plan that are believed to apply. Failure to raise any issue with sufficient specificity to afford the City Council and other parties an opportunity to respond to the issue will preclude appeal based on that issue.
