Elgin man gets sentence for sodomy, rape

Jeremy Flannery convicted for his involvement with a 15-year-old girl

An Elgin man was sentenced last week to jail time and supervised probation for his sexual assault of an underage girl.

Jeremy Lee Flannery, 35, was convicted of sodomy in the third degree and rape in the third degree Friday for his sexual assault with a 15-year-old girl last summer. 

Judge Brian Dretke sentenced Flannery to 36  months supervised probation, 30 days jail time and $560 in fines for the sodomy charge. He was sentenced to 30 days jail time, 36 months supervised probation and $580 in fines on the rape count, to run consecutive to the sodomy sentence.

Flannery has served as a sergeant in the Oregon National Guard but will likely be discharged due to the convictions.

“We’ve been tracking his case and we anticipate, especially with his conviction, that he will no longer be a part of the National Guard,” said Stephen Bomar, public affairs director for the Oregon Military Department.

Generally, individuals are discharged following a felony conviction, Bomar said, though discipline is handled on a case by case basis.

Flannery’s conviction came following guilty pleas to the counts in court Friday. He previously pleaded no contest. Charges of sexual misconduct, contributing to the sexual delinquency of a minor, sexual misconduct, sexual abuse and an additional count of third-degree sodomy were dismissed with no conviction.
