ENTERPRISE – Wallowa County was granted its motion for summary judgment June 13 in regard to a lawsuit filed to stop the auction of a foreclosed Imnaha ranch.

In granting the motion Judge Thomas B. Powers agreed with the county’s assertion that the two-year statute of limitations had expired when the previous owner of the ranch, Dave Talbott, filed suit in 2017.

The suit, filed Oct. 31 in Wallowa County Circuit Court by David Talbott of Joseph, claimed on or about Aug. 18 his family offered to pay back taxes and other expenses to the county, but the county rejected the offer and directed the Wallowa County Sheriff to sell the ranch at auction.

According to the complaint, the Talbotts owe $17,000 in unpaid property taxes.

In Wallowa County Circuit Court, Attorney Bruno Jagelski said the foreclosure was more than 10 years old before the complaint was filed.

“All rights were terminated at foreclosure. This is a classic case of ‘no good deed goes unpunished.’ Mr. Talbott was granted much more time and didn’t take advantage of it,” Jagelski said.
